I'm assuming that you do not have a lease and you are going month to month. Therefore, one party has to give the other party 30 days notice to end the tenancy. Technically, you are in violation of your lease if you do not pay your rent on the 1st of the month and she could start legal proceedings immediately. However, it would take some time to get to court and I'm sure you will have paid her by that point.
