We took over our lease from previous tenants who had to break their lease (basically, we got a 15-month lease, instead of 1 year). Our apartment was neither cleaned nor painted before we moved in. The walls were not in great condition (they definitely needed -- and still need -- to be spackled and painted). I am concerned that our landlord is going to try to withhold money from our deposit because of the damage from the previous tenants. Do we have any recourse if he tries to keep our money? How should I handle this?
I should add that our lease expired at the end of August, and we've been renting on a month-to-month basis while the landlord is in the process of selling the place. We're about to move out, and the landlord is already annoyed with us because we're moving out and have told him that we will not be paying him any rent for November.
