Well take your loss........

next time NEVER send a check, without a signed lease, and of course
make sure you make copies of the signed lease and your check, then you
could sue the bastard!

Did you put on your check deposit for XXXXX address????? that could
hold up in court.

About the only thing you can do is file small claims in the city where
you were going to move...and show the judge your application fee, your
phone records and you deposit check and hope the judge will side with
you.........

But then you will have to collect the money..... some states you have to
pay the judgment on the spot....you could ask the judge it be paid now,
since the Landlord informed you he had financial problems.... or you
could get a lien against his house, and of course ADD all the legal
and other fees to the total!

But then you might have to take a couple of sick days/ vacation/
personal days to go to court...150 miles away..

So its up to you........If you were in Sunny California...I'd sue the
asshole, but in Washington State winter coming.. Snow... would you be
able to get to the court on time in bad weather........

All things considered............i guess you lost $750.....

: I live in Wahington State. The incident that I am going to describe happened in Cashmere, WA.
: We were going to move to Cashmere which is about 150 miles from where we live currently.
: We sent the landlord of the house that we were going to rent $15.00 for the application
: fee. He told us everything went through fine and that we could rent the house. We then
: sent him $750.00 for part of the deposit. We had never signed anything. We found
: out a week before we were supposed to move that my husbands job oppurtunity fell through.
: We don't need to move anymore. We told him immediately. His wife told us that she
: would not be giving us the $750.00 back and that they were having hard times. I just
: want to know if we have a legal right to our money. Thanks.
