former tenant harassment

Posted by angela on January 12, 1999 at 15:56:19:

we recently bought a home, but for 8 and a half months rented the home of a friend.
he never took a deposit from us, and changed the rent price on us from 500 to 1000/mo.
we paid this each month and then paid his property tax bill because he complained
about having to pay it while we lived there! all told, we paid roughly 10,000
to this man in under 9 months. we also paid all utilities. while we lived
in this house we had to replace the fridge, his was old and not working well
so we brought our 8 yr old model from our house in another state. a rental prop
of our own. when we moved out of the friends house 2 mos ago, we brought our fridge with
us and supplied a fridge for his house that worked fine. he sold his house
and the new folks moved in and said the fridge didn't work, i told him that
it worked fine and was only 8 yrs old.
we feel that because we paid him so much money all year, paid his TAXES on
top of this, and left a perfectly fine fridge there that we don't owe him anything.
we think this is his way of trying to get moremoney from us and we are not paying.
we have our lawyer on retainer in this matter who advised us to not speak to this
man anymore. i told him to call our attorney, he refuses. we had to change
our number due to his harrassing phone calls all hours.
i guess i am looking for info from others who may have been duped like us.
anyone who can shed some light on this matter or how they might have handled
a similar situation. frankly, this man should have taken a deposit.
i also forgot to mention earlier that he did not perform an inspection of
the home after we vacated (we had given him 2 mos notice). he went ahead and
let the new buyers move in before their close date. he handled the whole situation
poorly and accroding to our lawyer was at fault for not doing the inspection.
i would welcome any input. i am a landlord myself and have all sorts of
documents and legal papers with our tenant and it is a good relationship.
thanks.
