No, he sounds like he's answering a question.

Late fees can be assessed, but if a LL goes to NYC Housing Court, he
can't seek late fees there because they are not part of "rent." But
he can go to small claims or civil court to seek the late fees. There's
also case law on what constitutes unconsciounable late fees, those
being too high. I remember seeing one such case in Tenantnet's
Housing Court Decisions section.
