Are you in NYC? or NYS? The shortest answer is YES: garbage is his resposibility, but recyling is shared with tenants. There might be a better answer from the main menu here on Tenant.net.
Here is the NYC Sanitation dept website: you can read about and download Recycling info, garbage collection info, even the actual law (if memory serves...). Or use search feature on main NYC website: http://www.ci.nyc.ny.us/ Those paint cans probably should have been Recycled.
