I remembered reading about something similar, but not a lawsuit, more of an how-to become a B&B interview.
So I did an 'all article' search inside the NYTimes using (copy everything inside the brackets): ["bed and breakfast" and "New York"] and two articles hit the mark, both in the Travel section Q&A:

February 16, 1997 Pied-à-Terre

August 18, 1996 B & B's in New York

They each list resources for finding B&B's, including listing agencies & a bookstore.
ps: what you describe can also be called a "vacation rental" or "short-term rental or sublet". Some people use the terrm B&B only for situations where breakfast is actually served & the owner does actually live in the apt.
