landlord must paint between tenants?

I lived in a Manhattan apartment (not RS) for 1yr and just moved out. My kids made some small crayon marks on 2 walls and there are some scuff marks at a few places.

Question, is the landlord required to paint the wall between tenants? If so, he is not doing anything extra to address these marks, so shouldn't deduct my deposit, right?

The Housing Maintenance Code requires repainting every three years, or sooner if required. For the crayons, it probably depends on how large it is, and the attitude of the LL.

For scuff marks, that likely falls into the normal wear and tear category. If you use something as intended, it will wear. That is what rent is for.

If the LL does not paint, then there's no excuse to deduct any monies. If he does paint, then it depends.

Thanks for the reply. It seems the housing code - paint every 3yrs, should apply to tenants who still live in the apartment right?

I have never moved into a place where it was not painted after the last tenant left. Even not required by housing code, LL would still want to paint and not leave normal wear and tear on the wall for a new tenant no matter how long the last guy was there, no?
