security deposit/lawsuit in upstate NY

my LL agreed to refund my security deposit but has not in the stipulated 30 days. I have yet to call or write to him demanding the original amount b/c I would rather sue him for double since he is a jerk. My question - can I sue him since the 30 days has passed or do I have to contact him & give him the chance to refund the original amount?

Your message belongs under New York State -- not under New York City.
 
In New York, there is no 30-day rule for the return of a security deposit, nor is there a penalty (such as getting back twice the amount of the security deposit) for not returning the security deposit in a reasonable amount of time.
