Movers damaged light fixture. Can LL take out of my security

Postby paganredhead23 » Tue Nov 03, 2015 2:30 pm

Hi:

We moved out of our building last week and the movers broke a light fixture on the ceiling of the lobby. The moving company assured us that they would assume the cost for any damages. However, I am concerned that the management company will take it out of our security deposit. Does their ability to keep the security deposit in the event of damage extend to common areas of the building? Sorry if this is a silly question. My lease is packed away and I am anxious to try to get some clarity on it.

Thanks

Some LLs ask/demand movers put up a bond for situations just like this. And if not, they might try to withhold your deposit, leaving you to seek redress from the moving company. It's not so much if there's law on this - I doubt there is - but what the LL can do. But at this point you're speculating. Follow-up with the moving company.
