Month-to-month in Nassau County facing eviction

I have been living in an apartment in Nassau County without a lease since last summer, on a month-to-month basis. Now I am behind in my rent, and the landlord is threatening eviction. Do I have any rights?

As month-to-month tenant either party, LL or tenant may terminate tenancy by giving at least one month's notice before the expiration of the term. For example, if the rent is due on the first of each month, the landlord must inform the tenant by March 31st before the April rent is due that he wants the tenant to move out by May 1st. But even after the deadline, the eviction is not automatic, LL would still need to take you to court and get a judgment and then have a marshal or sheriff actually evict you if you're still living in the apt.

In the situation that is described, the tenant is behind in the rent, in that case the landlord does not have to wait to serve notice, if the tenant is one day late, the landlord can start eviction procedures immediately.
