What is situation with month to month please?

Hello all, I am here seeking accurate advice on month to month leasing situations and would appreciate any help.

To being with, tenant had a one year lease, after the year had expired it was never renewed. One RE guy is telling me that we are now under month to month leasing rules, is this true or false please?

Assume this is you, yes?

If a lease expires and the LL continues to accept rent, then you become a month-to-month tenant, that in essence means the lease is extended from month-to-month with the same rent and same terms and conditions. LL can end or modify it in NYC with 30 days written notice. If given to you today, August 9, it would be effective on October 1st.

All this is so if you are not regulated. Have you checked to see if you might be (don't ask the LL - they will lie about it). Start by getting a rent history from DHCR, assuming the building was cnstructed prior to 1974 and it has 6+ units in it.
