Do I have to provide roommate with copy of main lease?

Postby photochic1124 » Fri Nov 17, 2017 11:22 pm

I am the main/solo tenant on a market rate lease. I have a written agreement with a roommate who is not on the main lease. He is demanding a copy of the main lease. Am I legally obligated to provide it? If he bypasses me and asks the landlord, is she legally obligated to provide it?

I won't go into details about why he's demanding it since it's kind of irrelevant to my question.

Thank you!

You are not obligated to show your lease to a subtenant. However, you should be transparent to put any suspicions to rest. I know of no law that requires landlords to divulge that information.

For rent regulated tenants there are rules that a subtenant not be charged more then 50% of the rent (and similar percentages if there are more than one subtenant). There are penalties for those tenants that charge too much. However that is for RS tenants, not unregulated tenants.
