Roommate security deposit

Postby loulilah » Mon Nov 23, 2020 11:58 am

I am the sole leaseholder in a unit shared with roommates. The terms of my last lease required me to pay first, last, security to my landlord, which he retains. Can I extend the terms of this last lease to my roommates? Or am I no longer able to collect last month deposit, even though my landlord retains mine, because of HSTPA? Thanks in advance.

First off, are you rent stabilized? Have you requested and received a rent history from DHCR? Do you live in a building with 6 or more units and built prior to 1974?

Then go to viewtopic.php?f=24&t=13981
and download No. 1. That gives you a summary of all the HSTPA changes, including what can be collected as a security deposit.
