Temporary Roommate Vs Illegal Sublet

Postby RJMNG » Sat Jan 04, 2003 4:44 pm

If you are renting an apartment, and subletters are not allowed, what are you supposed to do should you have to go away for a few months?

Can you get around the no sublet rule by getting a temporary roommate? At least that way pat of your rent is paid.

If the apartment is regulated, you can apply for a legal sublet. The LL can't 'reasonably' refuse this. That would cover you.

In a free market apartment, all bets are off. Whatever language the lease contains about subletting would control the issue.

Real Property Law §226-b(2) gives all tenants in buildings with four or more residential units the right to sublet.

The right to sublet has nothing to do with rent regulation.

though according to that the LL has the right to request information about the sublessee -- I assume credit check/financial info?
