Judge Compels Agency in Housing Dispute
In a departure from the common law rule that a court cannot compel a principal to continue to employ an agent, Bronx Supreme Court Justice Paul A. Victor issued a temporary restraining order requiring a non-profit organization that owns residential apartment buildings in the Bronx to continue to use a management agency to run the buildings. Justice Victor ruled the matter to be a case of "agency coupled with the public interest" because the owners had caused the buildings to deteriorate since firing the management agency in May. The decision is Building Management Associates Inc. v. Yolanda Rivera.
