Two year lease

I have a problem that I hope someone can help me with. In 10/01 I signed a two year lease on an apartment in NYC with a roommate and both of our names were on the lease. In 4/02 I moved out and obtained a new roommate to take my place, while I remained a tenant of record. This person has left the apartment as of today 1/3. I have moved out of state for job reasons. The roomate that I signed the lease with originally is telling me that I have to pay the rent until we get a new person for the remainder of the lease, nine months, 1/03-9/03. He is threatening to sue me if I don't pay the rent until we get someone. Can anyone offer me advice on this matter?

I don't think he has a leg to stand on.

Surely, there is no way you are responsible despite you being in name on the lease.

I'm not sure about the roommate's case, but if he does not pay the full rent, the landlord may take action against you. You are on the contract as well as your roommate, and you are both legally responsible for paying the rent.

At this point I would concentrate on finding another person to sublet your portion of the apartment, if you end up having to pay rent for a place that you don't even live in, at least try to minimize the amount of time it is vacant.

what happened to your security deposit when you moved out of the apartment?

As long as your signature is on the lease it means YOU have to pay whatever portion you and your former roommate agreed on.

Before you moved out, you should have tried to break the lease with your ll. It doensnt sound like either of you were aware of the consequences of you just moving out.
