BROKER TOOK $ for credit chech on a non-available apt wh

A broker in Brooklyn took money for a deposit and four credit checks. Then turns out the apartment was taken a couple of hours before me. The broker did not contact the landlord and went ahead and did a credit check. The apt. is taken and he won't give me back the money for the credit check that he did for an unavailable apartment. I want my money back what should I do? he's just taking advantage of a student but $53 bucks is a lot for a student. please email mi327@nyu.edu
