I just moved into a new apt. I found after moving in that the upstairs neighbors have a history of leaving their water on and causing floods. I have been here 3 weeks, and today the water came dripping through my bathroom fan. SInce I know there is a history of this, and I can probably ask/get the previous tenant to list the problems for me, could this be used to break my lease (2 year one) without losing my security deposit?
