garage converted to room - legal?

I just saw a house for sale. The R.E. agent said that it is a legal two family. But the garage was converted into a bedroom, so the basement is what some people call a "walk-in" one bedroom apt. The previous owner got a permit to add a kitchen (stove, sink, etc.) in the basement. There is also a full bathroom. My question is, Is the bedroom (which used to be a garage) legal? It has heating and windows and is at ground level. The agent told me that the garage was converted in the 1950's.

Go to the Building Department and see if the certificate of occupancy for the building includes the apartments mentioned. If not, they will have a hard time getting a buyer's mortgage company to grant the mortgage. Good Luck

It may also depend on the zoning and if the basement is legal -- could have to do with fire egress.
