splitting up -- who gets the apartment?

my partner and i are splitting up due to her violent behavior. she needs to move out, but her name is on the lease along with mine. however, the lease guarantor is one of my parents. does anyone know what rights i have to get her out of the apartment (other than a restraining order, which i don't want to do?) and/or liabilities? i'm really in the dark on this one.

If your partner's name is on the lease as a co-tenant, she has all the same rights of staying in the apt as you. I don't see how short of a court issued restraining order can she be forced to move out, unless she was not paying rent or being disruptive and a nuisance to other in which case the LL can initiate holdover proceedings, but this may backfire and also have you evicted along with your partner.
