tenants do not want to move out

Hello all,

A friend and I recently rented a new apartment and are planning to move in February 1st. We have not been dealing directly with the landlord, but, just with the tenants in getting the lease and paying the deposits. Today the current tenant called and said they do not want to move out because the house they buying fell through. My friend and I have paid a security and 1st month rent deposit for this apt and the checks have been cashed by the landlord. We also have a signed lease starting on Feb 1st.

Do the current tenants have any legal right to withdraw now and not leave? Are there any legal concerns I should be aware of. I'm under the impression that since the landlord cashed our checks that the place is ours.
