LL withholds 1/2 depost for 5 day agreed upon overstay.

The management office and i agreed to the 5th of Jan. as move out day, with them to bill me for the extra days (lease terminated Dec. 31st). A few days later they returned only half my deposit, citing my overstay as the reason they could not rent the apartment to a new tenant by the 1st of Jan. This, obviously, is a crock. Should I just take him to court and can I win?

UPDATE - I just got a check for the difference in the mail, all i had to do was write the owner a nice affable letter asking for it. Maybe they aren't all so bad after all

What is the basis of keeping half the security deposit?
In any event, whether you win or not depends on whether you can prove the agreement existed. Certainly worth a try--that is what Small Claims is for.
Keep in mind that I am a tenant. Not a lawyer!!!!!
