No Cert. of Occupancy........Am I at Risk?

I've just been offered a good deal on a brand new apartment, which was constructed as part of an extension of an existing 2-family building.

However, no Certificate of Occupancy has been issued...........and it's my understanding that the owner will not seek to 'make it legal.'

I know if the lack of a C of O is discovered by the appropriate authorities, the owner will be in deep trouble, but what about me, if I decide to rent it? Can the city throw me out on the street immediately after?
