Breaking my lease

Postby peegeelee » Thu Jan 09, 2003 1:48 pm

Hi, need some advise. I and my family live in a 2 bedroom apartment in Manhattan. We might have to live NYC for another city in the US in 2003 (job transfer). I am still working on the details and dont know exactly when we will have to go. My lease ends in November 2004. I would like to know if there are any rules/laws which allow me to break the lease under certin confitions. In Switzerland for instance, if you find a new tenant accepting to take the apartment in the same conditions and at the same price, you are basically free to leave without any penalty and with getting back your entire security deposit (assuming they are no damages). Is there something similar in the US and in NYC?
Is there anything I can do?

Does the "diplomatic clause" exist in the US and NYC (i.e. a clause in the lease allowing me to break the lease for job moving reason)?

PS: Rent is not stabilized.

Thanks a lot
