Eviction notice...please help!

I've been out on disability since July of last year. In Jan. my husband lost his job. We have three children and are now facing eviction. Our landlord told me on May 11 that I would have 3 weeks to come up with 2 months back rent or be evicted. Last night he called to say that we have until tomorrow or he will give us an eviction notice and we'll have three days to vacate. Is this legal? I have proof that workers comp. messed up my payments and owe me more money but he wants it now. Any suggestions?

In order to legally evict you, your LL must take you to court.
