domestic partners in 80/20 apt.

Postby robert cox » Sat Nov 23, 2002 12:14 am

i am moving into my girlfriend's moderate income 80/20 apartment. the lease states that only spouse or children may reside in the apartment. aren't domestic partners treated as spouses by law? do we have anything to worry about?

I'm not a lawyer and I'm not really familiar with 80/20 housing but, subsidized housing generally has very strict income and family guidelines.

Part of the problem with a Domestic Partnership is that, unlike marriage, it tends to be after the fact. If you're "going" to move in with your girlfriend it would be hard to demonstrate that you already have a domestic partnership, particularly if you haven't formally registered your partnership.

I would also presume the rent would have to be adjusted for the current household income rather than the amount your girlfriend provided when she originally moved in. Given the idea that there would be two incomes your household may no longer qualify.
I'm a cranky tenant NOT a cranky lawyer.
