Rent paid but no apartment...

Postby j0879 » Mon Dec 09, 2002 5:06 pm

It's been almost a month since I signed my lease...and the landlord keeps moving back the move-in date because the building is not finished (construction, inpections, etc) We still do not have a definite move-in date and have moved 2 or three times while the landlord is sitting on $6000 dollars of our money and we are getting little or no compensation. What are our rights? Any advice? Why is it that we have to abide by a contract as rentors but the landlord does not? Strange...

Do you have a copy of the lease?

Most leases have a provision about a delay in giving possession to the tenant.

You may have a right to cancel the lease and get your money back if there is an excessive delay in giving you possession. The lease should say what you have to do to cancel the lease.
