My roommate refuses to pay the rent

Postby NYLover » Sat Dec 04, 2010 3:58 pm

(1) It's already Dec. 4 and my roommate refuses to pay the rent. What can I do to make her pay the rent?

She told me to keep the deposit to replace the rent, but there are already some damages to my apartment that she obviously doesn't want to pay for.

And there are also at least two month's utilities bills she has to pay me.

It's just that she will leave for some other city at the end of the month and I need her portion of the utilities and the cost to repair the damages from her.

(2) There's no written "Roommate Agreement" btwn us, which I sorely regret. If she want's bring her guest, do I just have to accept?

Any inputs will be greatly appreciated.

Guess what, you're now a landlord. If you want her out, you can commence a licensee proceeding in Housing Court. Depending on the damages, you can file in Small Claims Court. But remember, this is TenantNet.

In a situation like this, persuasion and negotiation are perhaps your best tools.

Do not lock her out as you could face criminal and civil charges.
