HPD jurisdiction in Housing Court

I brought a case to housing court for mold spores in my apartment coming from the cellar beneath it. The cellar mold has been verified by the Dept of Health. The judge would not sign my subpoenas for lab reports, dectors' reports, etc, until HPD inspected the cellar and verified the mold.
Is it a fact that one cannot bring a matter with corroborating evidence to housing court unless HPD investigates the problem beforehand?
