I have one more question. I found the non-payment petition sent to me by landlord lying in the hallway. It was not delivered to me by hand or even mailed. It was just lying in the hallway several feet away from my apartment. I just happened to pick up paper in the hallway and realized it was for me. I am not sure how it got there. Can I hold this against the landlord? Had I not seen it he could have gotten a default judgment against me. Perhaps that was his intention.

It's called bad service. Read up on service requirements and when you go to court ask for a "traverse" hearing.

I was wondering if anyone can let me know how bad is it to have a non-payment petition filed in court. I think the landlord and I are finally going to settle it out of court and they will dimiss the case but I am just curious as to how their filing the initial non-payment petition will affect my future apt. hunting.

Does this go on my permanent record and will other landlords have access to it?
