California - online rental agreement?

Postby jdbean » Thu Jun 27, 2002 5:30 pm

I recently expressed interest in occupying a unit. I did so online and did not include the proper address of the apartment rental.

I rescinded my interest after 48 hours and the owner is now threatening to sue me for damages.

I maintain that I didn't feel we had a legally binding agreement, after all I never Signed anything...

ideas anyone?

Certainly does not sound like you had a binding contract, although you may want to read the websites disclaimer and policies.
Contract law in most states require certain elements 1. Offer 2. Acceptance 3. Consideration to make a contract valid.

From the 'Lectric Law Library's stacks

Please post the web name and or the LL/Agent, so other Californians can be warned...

Best of Luck!
