I have been able to find laws pertaining to non-requirement of a 30 or 60 day notice to a landlord if a sole tenant of a month to month apartment dies. However, I could not find anything in writing or specific laws/statutes that explain what happens to the security deposit if a sole tenant dies. Here is the scenario. A sole tenant pays the rent on the 1st of the month, dies on the 5th but the body is not discovered by a relative until the 10th. The relative then notifies the landlord and proceeds to clean the apartment to its move-in state and remove all of the sole tenant's belongings by the end of the month. The sole tenant will have bequeathed to the relative in a will all assets and belongings including the $1500 security deposit on the apartment. Is there a law that states that the landlord must return the security deposit to the relative? I have searched online and the local Law Library but xould not find anything in writing. I would appreciate any help. Thanks.
