eviction help in upstate ny

I am in New York State, Otsego county to be exact. I am being evicted for past due rent of which i really do owe.
I have the money to pay the landlord now, he has refused it.
Anyway, myself and my husband and five kids live in the house, i have a one year lease, i know by being late i violated the lease, but i have been late previously and was charged $100 per week for every week i have been late, which i have paid. the late fee of $100 is on the lease.
About serving the papers, does the landlord has to serve my husband and myself individually or can the notice of petition be just one for both of us.
I have a lot of threatening and harassment emails from both him and his wife.
A few days ago he came to the house and took photos, he knocked and walked right in, he said it's his house and he can do whatever he wants.

Anyway, if he doesn't accept the rent money , will i get time to leave before i am evicted by the sheriff? Seeing that he doesn't want the rent.. i have been looking for another place.
