need help- sister stay of execution expires...

Postby willardk » Sun Jul 28, 2002 10:26 pm

My sister who has been of out of work for a lonnng time lost her case back in may and has a stay of execution that expires wednesday 7/31 or actually end of business 7/30. We have finally been able to gather the funds for the arrears through various agencies and have also been paying current rent as per the stay of execution.

My questions:
We plan to overnight the payment to the landlord,cc her lawyer and the court. Can she still be evicted?

Does the landlord have to petition the court to get the marshal to act? or is it automatic? in other words does she still need to do an order to show cause even after paying the arrears before the cut off date??

Does the marshal who gets sent still have to leave a 72 hour notice? or is it different with a stay of execution? Will she have any warning.

reason she crazed is that she actually found a job but needs to be out of the apartment on 7/31 for training from 7am to 5pm. She can't get out of it and she wrecked with fear she'll come home to a padlocked apartment.

any help appreciated.

thanks
Will
