If a court has issued a judgment of Possession by a certain date, and the tenant does not leave on that date, does the typical Marshall procedure (serve notice, then 72 hours waiting) still take place? Or can the marshall come by & remove the tenant any time after the date of possession has passed?
Usually, but it depends on the situation. If the marshal has sent notice before and it was stayed, the judge can waive further notice for the certain date. You really have to read your order and know the stance of the eviction.
