Improper Service Of NOTICE OF PETITION Non-Payment

A folded NOTICE OF PETITION Non-Payment was placed under my door on Monday February 24. The date on the Notice is February 18.

On the opposite side of the notice is the petition. Attached to it is the 3 day notice, which someone hand delivered to me a week earlier. On the back of it is the affidavit of service.

Attached to it is another copy of both of the above.


There is a program that I found on a new york city court website that asks you questions and then generates instruction on what you should do.

It showed that I have 2 defenses: 1) Improper service, 2) Warranty of Habitability.

Is it indeed improper service and should I use it as a defense if it is?

Wouldn't it just delay the proceeding?

Wouldn't it also annoy the judge?
