Landlord filed same preferential as legal rent

I just received the history for my rent stabilized apartment, and the previous tenant was paying a legal rent equal to the preferential rent. But I was charged a vacancy increase of 20%.

Since the previous tenant signed a 2-year lease, shouldn't the vacancy increase by 10% because he was paying preferential rent and the tenancy was less than 3 years? Do I have a case to get my legal rent corrected by 10%?
