Satisfaction of Stipulation of Settlement

Postby Mark B » Fri Sep 02, 2016 4:54 pm

Hello,

I entered into a stip with LL to pay all rent arrears by Sept 15th. Part of my arrears were paid by HRA, the other part I now have to pay. The stip states if the payment is not received by this date, a warrant of eviction will be issued.

1. Does LL or his attorney need to do something in order for the warrant to be issued...or the filing of the stip was all that was needed...?

2.How will the court know that the payment was made so as not to issues a warrant

Signing a stip can get you into trouble if you don't meet the terms. If you don't pay they can go back to the court for the warrant. Not positive, but I do think they need to go back, that it doesn't happen automatically. But you should check that out with the court.

Did you pay? Did the LL accept the payment? Can you prove you paid? (sent certified mail with your keeping copies of the check or MO?)

If it's only a few days the court might let that slide, but still be prepared to have a good excuse. LL might still come after you even though he has the money.
