Hello all

MCI Useful Life Schedule
19) Courtyards / Walkways / Driveways

Building owner plans to redo the sidewalk in front of his building. I took pictures and there is nothing wrong with the sidewalk. They Claim the insurance carrier of his building said they have to replace the sidewalk.

It is clear this is not the Courtyard or Driveway. Does Walkways include a Public Sidewalk in front of his/her building ?

Fact Sheet number 33 is not clear on this. I'm thinking Walkways does not include public Sidewalks. Therefore building owner cannot file for an MCI on a public sidewalk.
Am i correct or incorrect.

I don't know and haven't seen any cases on this. I would call DHCR and ask. If the hotline doesn't know, you can ask for an Opinion Letter.

I would think not as public sidewalks are required by the city, but individual owners are responsible for their maintenance. If you see nothing wrong, then chances are the insurance company story is bogus.

TenantNet's is correct. This is between DOT and Owner. Not an MCI.
