Rent renewal on RTP-8 ETPA vs RTP-8

Hello

It is time for me to renew my rent for next year.
Usually i get a plain RTP-8 form.
Now they sent the lease not certified. I found it in the mail box.
Now they are using RTP-8 ETPA ( 9/19 ) ETPA=Emergency Tenant Protection Act

What is ETPA. On the back of the form it mentions the instructions for Owner and tenant.
But the contact information displays Rockland, Westchester and Nassau counties.

The regular RTP-8 has contact information for Brooklyn, Manhattan, Staten island, Bronx and Queens.

I live in Brooklyn.

Did they send the wrong form? I believe they are pulling a fast one on me.
Am i correct ?

ETPA as you discovered, is the Emergency Tenant Protection Act (should also say 1974), is the enabling legislation passed in Albany that is renewed every few years. That allows the NYC Council to "opt-in" to the Rent Stabilization.

Without getting too deep, perhaps you might wish to research the beginnings of RC and RS for yourself. In 1969, the NYC Council passed its own form of RS. The state said, no so fast and passed deregulation. But after a few years things got so bad, the state then passed the ETPA in 1974.

That allows NYC and the three counties (Nassau, Rockland, Weschester) to opt-in if they follow the state's provisions. See details at https://hcr.ny.gov/rent-stabilization-a ... ection-act

There are differences between NYC RS and RS for the other counties.

I have not heard of any case where the version of the RTP-8 makes a difference, but why take the chance?

Fast one? I would think more ignorance. You can check with DHCR, but I would send the wrong version back to the LL and ask them to send the offer using the correct form. Give them the URL so they have one.

Also make sure they send the correct version of the DHCR Informational Rider.

Depending on your LL, I might send by cert. mail, or at least use a Certificate of Mailing.
