Exceptions to SCRIE's Required Income?

Hi guys. I presently live with my dad who's on SCRIE. He receives social security income. My income along with my dad's income comes to around $51,000. Even though the cutoff is $50,000 to maintain SCRIE, can the dept of finance make an exception to allow my dad to keep his frozen rent since we didnt know our combined income was going to turn out to be this much?

OK, so welcome back and thanks for making that correction.

A few thoughts. As far as we know, the Household income limit is absolute. We think it's how SCRIE calculates the income, not just a figure from your IRS form 1040. Still, it's probably similar to the Adjusted Gross Income. The NYC DOF calculates your income. See https://www1.nyc.gov/site/rentfreeze/fr ... -rent.page

Have you tried working with the IRS calculation? Did you miss any allowable credits or deductions? Do they count 100% of your father's SSA income?

We can't say they will solve the problem, but they are accessible. We also recommend you stay away from 311. They know nothing about SCRIE despite what they claim.

This is from 2015, but I don't think things have changed that much ... as far as we know, the limit is still $50,000.
