NYState law on taping phone calls

Postby irisham » Wed Dec 11, 2002 2:10 pm

Is it legal to tape-record phone conversations with individuals without their consent in New York State? I know Linda Tripp ran afoul of Maryland law in doing so with Monica Lewinsky, but mine would be to establish a set of facts about violation of rent stabilization law.

I think it's legal as long as it's done by one of the parties to the call. I'd make the tape, then run it past a lawyer before you try to use it.

No need to run this one by a lawyer. It's legal as long as both parties are in New York. (If one party is in a state where it is illegal, then the taping is illegal.)
Keep in mind that I am a tenant. Not a lawyer!!!!!

Actually it isn't a question of whether it's legal but rathar whether it can be admitted as evidence in court.

In New York it's "legal" and admissable as evidence, to tape a teldphone conversation, as long as one party knows they're being taped.

You can get the equipment pretty cheaply at any Radio Shack.
