I just lost a DHCR case, and BOY is it a nutty decision! I just found the following on a landlord website:
"Many Landlord's are successful on PAR's simply because they are reviewed by administrative personnel at DHCR, as opposed to the original tenant complaints, which are reviewed by clerical personnel whose decisions are not always based on the law and regulations."
Is this true? I was wondering because the decision was just nutty--the so-called "rent administrator" seemed to have a screw loose.
Yes, I have filed a PAR.
Also--has anyone filed an Art. 78? (Assuming I lose--I want to fight this one!) How much is the retainer?
