I just received papers that the management company is bringing a non-payment suit for the months of March 03 and December 02.

They originally sent me a 3 day notice in February claiming I hadn't paid rent for December, January, and February, so I sent them a letter with a copy of the cancelled checks.

Interestingly, the 3 day notice was dated the same day February's rent check cleared my bank account.

Now they claim they still hasn't received December's rent but didn't explain why they included March, since they acknowledged they did . in fact, receive and cash the check. Of course they're also adding over $200 in legal and late fees.

I have all of my cancelled checks and a copy of the letter so I'm not terribly worried about going to court. I was just wondering if this could be considered harrassment. I'm a longtime tenant in a rent stabilized apartment. The management company and I have a number of longterm issues that still are pending with DHCR.
