question about sublet rights in a rent stabilized apt.

Postby nyseven » Mon Jun 02, 2003 5:15 pm

I've been living with a roomate in a rent stabilized apartment for over three years. My name is not on the lease, but my half of the rent is sent (by check and cashed) each month to the landlord. Am I considered a legal tenant or could my landlord evict me if my roomate decided to leave the apartment? Thanks for your help.

If your name is not on the lease the LL can evict you unless you are a type of family member that grants you succussion rights under the regulations.
