Is there any way to find out if an apartment is rent stabilized (vs. rent controlled)? I know the rent; in fact I have a rent bill for the place.

Is it true that if a tenant leaves (or dies) a rent controlled apartment, the apartment could then rent at market value? And that if the same apartment is rent stabilized, the rent could only increase 18% or 1/40th the cost of renovations?

Get a copy of the lease for the apartment, take it to the DHCR http://www.dhcr.state.ny.us/ora/ora.htm and ask for a 'rent history' or 'apartment detail'. This document will have a code that says "RS" or "RC" under "status" i believe. That should answer your questions.

When a rent controlled tenant vacates, the apartment undergo's whats called a Fair Market Rent Appeal. More information on that can be found at http://www.housingnyc.com/resources/dhcr/dhcr6.html.
