Postby RossP » Wed May 10, 2017 12:04 pm

Post was too long It was 3,425 words long!
In nutshell:

All I wanted; I wanted my security deposit; $1700.00
Totaling a cost of losses entitled of reimbursements $6,307.28
Total security deposit; $1700.00 in security + $22.42 interest over 3 years= $1722.42 minus reimbursement for damages…. leaves a total balance due of $ 4,584.86 You can make this check payable to ( ) and mail it or leave it at ( ) with the Property Manager,( ), with your new address so I may send you all the receipts to these bills.
Lived here 2years 7 months
Pay or court? Doomed.

All I wanted was my deposit back.
If anyone, anyone at all has a suggestion, please?[/size]

Sorry, I'm not going to even attempt to read all that. Try shortening it so it fills one screen of your display without having to scroll. Don't include the text of every missive sent or received. If we need more info, we'll ask.

Almost any issue can be summed up in a vary short message. Please show some respect by not assuming that I have all day to read one message.

So, the landlord is claiming that you caused $6307 in damage to the apartment? Did you cause damage? How has the cost of the damage been documented?

OK, let's look at this.

The building itself. How many units approximately? More than six?
When was it built - approximately? Is it very old, or might it have been built after 1974?
Can you give us the Borough and address? If so, send via Private Mail (use the PM button on the left side of your post).
Who is the owner, if you know? The name on the lease?

You posted in the non-regulated section, but many units that LLs claim are unregulated, might indeed be regulated. If there is something to that, that might give you some leverage.

Assuming you have an actual lease, when did it start? How long was the term of the lease? Was it renewed, or is this the first year/term? What was the rent?

In a very short nutshell, why did you move out? What date? How much time was left on the lease? Did you give the owner written notice of the reasons or complaints that led to your moving out?

When you moved out, did the owner do a walk-through inspection with you? Did you ask for or offer to do that? Did you take copious photos of the unit and conditions just before move-out? Did you take photos or take notes of anything in need of repair or otherwise not in pristine condition when you moved in (for comparison purposes)?

When you moved out, how did you return the keys? To whom? Did you get a receipt for the keys?

As Bubba (our token LL) asked, was anything actually damaged during the time you lived in the unit? How did that damage occur? Was there any documentation of the repair costs?

OK, so please answer all these questions. But make it short, no explanations. Just yes/no or whatever.

OK second, AFTER you've answered all the above, if you have the letter from the LL detailing the claimed damages, please scan that and send it to us as a PDF, attached to a Private Mail. Do not attach it to a post in the public area of the forum.

Second, provide a timeline of what actions you took and any LL responses. In short, date and what happened. For example:
5/11/17 letter to LL giving 30-day notice of move-out
6/1/17 email to LL asking for walk-though
6/10/17 gave keys to super, he gave me receipt of keys

and so on.

One other thing I forgot, is there any paragraph in your lease regarding move-out and notice?
