LL breaking lease prior to move in date

Postby anita814 » Sat Jun 15, 2002 5:38 pm

I recently signed a lease. A few days after signing, the Landlady calls me saying the lease is "cancelled" because she wanted to renegotiate the rent. Our move in date is July 1st and she said she won't allow us to move in! The lease did not allow for a recission period. Although it did allow for 60 day notice of cancellation, for either tenant or landlord. I don't know how to go about handling this. Can anyone help?

Has she deposited your security deposit or any payment that you have given her for the apartment? If you have given her payment and she has deposited that payment then the lease is valid and binding.
