i reside in a bronx mitchell lama rental and we would like to establish a Screening Committee to greet new tenants, monitor the waiting list, and be notified about moveins and moveouts to keep a handle and prevent (as much as possible) subletting. any dos and don'ts would be appreciated.

Is this a co-op or a rental building. Do you have the approval of the co-op board or the building owner? If the building is a Mitchell-Lama rental, the regulations require that the owner recognize a legitimate tenant asociation, but that does not necessarily mean that the owner or management will allow you to screen tenants.

Is the regulator DHCR or HPD? Each has their own procedures on allowing the tenants association to monitor the waiting list--a very important issue because many managers appear to take illegal kickbacks to allow people to ignore the waiting list.

the regulator is DHCR for my mitchell lama RENTAL.

You'd have to approach management with your plans and see if they could be of help. In a privately owned development, management is not required to give you any of the information you mention, and it could even be seen as an invasion of incoming tenant's privacy.

However if you present a thoughtful case and show how your efforts would improve the building value overall, perhaps management would be of assistance.

The DHCR Mitchell Lama regulations require that the management of a Mitchell Lama rental building recognize a duly constituted tenants association and work with the association.

You might find it helpful to contact the DHCR site regulator who can explain DHCR policies concerning tenant screening committees. They are located at 25 Beaver St. in Manhattan (212) 480-6700.
